Terms and conditions for using our educational services

Agreement to Terms

By accessing and using the services of Sgherplowki English Learning Centre, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, please do not use our services.

1. Definitions

  • "You," "your," "student" refers to the individual using our services
  • "Services" refers to all educational programs, courses, and related services provided
  • "Website" refers to sgherplowki.com and any associated online platforms

2. Educational Services

Course Enrollment

  • Enrollment is subject to availability and our admission requirements
  • Students must provide accurate information during the enrollment process
  • Course schedules and content may be subject to change with reasonable notice
  • Students are responsible for meeting attendance requirements

Academic Standards

  • Students must maintain appropriate conduct and respect for others
  • Academic integrity is required; plagiarism and cheating are prohibited
  • Regular attendance and participation are expected
  • Assessment results reflect student performance and effort

3. Fees and Payments

Payment Terms

  • Course fees must be paid in full before course commencement unless alternative arrangements are agreed
  • Payment can be made by cash, credit card, bank transfer, or approved payment plans
  • All fees are quoted in Australian Dollars (AUD)
  • Late payment fees may apply for overdue accounts

Refund Policy

  • Full Refund: Available if course is cancelled by us or student withdraws before course commencement
  • Partial Refund: Calculated on a pro-rata basis for withdrawals within the first 20% of course duration
  • No Refund: Available for withdrawals after 20% of course completion
  • Processing: Refunds will be processed within 14 business days of approval

4. Student Responsibilities

Attendance and Participation

  • Regular attendance is essential for academic progress
  • Students must notify us of extended absences
  • Make-up classes may be available at our discretion
  • Students are responsible for catching up on missed content

Code of Conduct

  • Treat all staff and students with respect and courtesy
  • Maintain a positive learning environment
  • Follow all safety procedures and guidelines
  • Comply with all applicable laws and regulations

5. Intellectual Property

All course materials, including but not limited to textbooks, handouts, audio recordings, videos, and online content, are the intellectual property of Sgherplowki English Learning Centre or our licensed partners.

Permitted Use

  • Course materials may be used solely for personal study purposes
  • Sharing or distribution of materials without permission is prohibited
  • Recording of classes requires prior written consent
  • Commercial use of any materials is strictly forbidden

6. Privacy and Data Protection

7. Limitation of Liability

Our Liability Limitations

  • We provide educational services to the best of our ability but cannot guarantee specific learning outcomes
  • Individual results may vary based on student effort, aptitude, and circumstances
  • We are not liable for delays or disruptions due to circumstances beyond our control
  • Our total liability is limited to the fees paid for the specific service in question

8. Force Majeure

We shall not be liable for any failure or delay in performance due to events beyond our reasonable control, including but not limited to:

  • Natural disasters, pandemics, or public health emergencies
  • Government actions, regulations, or restrictions
  • Technical failures or internet outages
  • Labor disputes or strikes

9. Dispute Resolution

Internal Complaints Process

  1. Initial discussion with course instructor or student services
  2. Formal written complaint to Academic Director
  3. Review by management and response within 10 business days
  4. Appeal process available if not satisfied with initial response

External Resolution

If internal resolution is unsuccessful, disputes may be referred to:

  • Australian Skills Quality Authority (ASQA)
  • Victorian Civil and Administrative Tribunal (VCAT)
  • Office of the Australian Information Commissioner (privacy matters)

10. Governing Law

These terms are governed by and construed in accordance with the laws of Victoria, Australia. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Victoria.

11. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our services after changes constitutes acceptance of the modified terms.
